Terms of Use for SaddleTalk

Welcome to SaddleTalk! These Terms of Use ("Terms") govern your access to and use of the SaddleTalk mobile application (the "App") and any related services (collectively, the "Services").

By downloading, installing, creating an account, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

SaddleTalk is a communication platform designed specifically for equestrians, enabling users to communicate via audio calls while on horseback. The Services include audio calling, recording, and transcription features (powered by third-party services like GetStream), as well as data storage and user authentication (powered by Supabase).

2. Safety and Assumption of Risk

Crucial Warning: Riding horses is an inherently dangerous activity. You acknowledge and agree that your use of the App while engaging in equestrian activities is entirely at your own risk.

Focus on Safety: You must prioritize your safety, the safety of your horse, and the safety of others around you at all times. Do not let the App distract you from safely controlling your horse.
No Liability for Accidents: SaddleTalk, its developers, and its affiliates are not liable for any injuries, deaths, property damage, or other accidents that occur while you are using the App, listening to the App, or interacting with the App while riding or handling horses.
Follow Local Laws: You are responsible for complying with all local laws and regulations regarding the use of mobile devices and headsets while riding or operating machinery.

3. User Accounts

Registration: To use the App, you must register for an account. Check our Privacy Policy for details on the information we collect.
Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.
Accuracy: You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Acceptable Use Policy

You agree not to use the App to:

Communicate threatening, abusive, harassing, defamatory, or hateful content.
Violate the privacy rights of others. Please note that when recording conversations using our platform, you are solely responsible for ensuring you comply with all local laws regarding recording consent.
Transmit viruses, malware, or any other harmful code.
Interfere with or disrupt the operation of the App or its servers.
Attempt to gain unauthorized access to the App, other users' accounts, or our computer systems.
Use the App for any illegal or unauthorized purpose.

5. Third-Party Services

SaddleTalk relies on third-party services to function, including but not limited to Supabase (for authentication, database, and storage) and GetStream (for audio/video communication and transcription).

Your use of the App is also subject to the functioning and availability of these third-party providers.
We make no warranties regarding the continuous availability, accuracy, or reliability of these third-party services (for instance, the accuracy of call transcriptions).

6. Intellectual Property

All intellectual property rights in the App, including its design, text, graphics, logos, and software, are the property of SaddleTalk or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Data Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and share your information, including conversation recordings, transcriptions, and account data.

8. Account Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. You may also delete your account at any time through the App's settings. Upon deletion, your data will be handled in accordance with our Privacy Policy.

9. Disclaimer of Warranties

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SADDLETALK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date or through an in-app notification. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
